Terms of Service

Welcome to the website of Midwest True Home Inspections, LLC ("Midwest True Home Inspections," "we," "us," or "our"), located at midwesttruehome.com (the "Site"). These Terms of Service ("Terms") govern your use of the Site, including its booking and contact features. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. What the Site Is For

The Site provides information about our home inspection services and lets you request and schedule an inspection or send us a message. The Site itself does not perform an inspection, and nothing on it is a home inspection report, professional advice about a specific property, or a guarantee or warranty of any kind.

2. Inspection Services and the Pre-Inspection Agreement

The inspection itself is a separate service governed by our Pre-Inspection Agreement, which we send to you for review and signature before your inspection. A preview is available on our Agreement page. That agreement sets out the scope and limits of the inspection, our responsibilities and yours, and our limitation of liability. If these Terms conflict with a signed Pre-Inspection Agreement about the inspection services, the signed agreement controls.

3. Booking and Scheduling

• Appointment times are shown in Central Time and depend on our availability at the moment you book.
• You agree to give accurate, complete, and current information, including a working email address and phone number and the correct address of the property.
• Your booking is confirmed when you receive our confirmation email. We may need to reschedule or cancel an appointment because of scheduling conflicts, weather, safety concerns, or circumstances outside our control, and we will contact you if that happens.
• To reschedule or cancel, reply to your confirmation email or contact us as soon as possible so the time can be offered to someone else.
• You are responsible for making sure we have permission and access to enter the property at the scheduled time, as described in the Pre-Inspection Agreement.

4. Pricing and Payment

Pricing is described on our Pricing page and may change without notice. The final fee depends on the property and any additional services requested, and is due as stated in the Pre-Inspection Agreement. We accept the forms of payment listed on our FAQ page. Prices shown on the Site are not a binding offer until confirmed by us in writing.

5. Acceptable Use

You agree not to:

• submit false, misleading, or fraudulent information, or book an appointment for a property you have no right to arrange an inspection for;
• use the Site in any way that violates the law or the rights of others;
• send spam, malware, or any content that is harmful, abusive, or unlawful;
• attempt to gain unauthorized access to the Site, the administrator dashboard, our systems, or other users' information;
• interfere with or overload the Site, or use bots, scrapers, or automated tools to book appointments or send messages in bulk.

We may refuse service, cancel bookings, or block access if we reasonably believe these Terms have been violated.

6. Intellectual Property

The Site's content, including text, graphics, logos, photographs, and design, belongs to Midwest True Home Inspections, LLC or its licensors and is protected by intellectual property laws. You may view the Site and print or share pages for your own personal, non-commercial use. You may not copy, modify, distribute, or use our content or branding for any other purpose without our written permission. Your inspection report is provided for your use as described in the Pre-Inspection Agreement.

7. Third-Party Services and Links

The Site relies on third-party services, such as Google (Calendar, Maps address suggestions, and Fonts), Cloudflare, and Resend, and may link to other websites. We do not control those services or sites and are not responsible for their content, availability, or practices. Your use of them may be subject to their own terms and privacy policies.

8. Electronic Communications

By booking or contacting us, you agree that we may communicate with you electronically, including by email and phone, about your booking and inquiry. These communications satisfy any legal requirement that they be in writing.

9. Privacy

Our Privacy Policy explains how we collect, use, and protect information, including information handled through Google services. By using the Site you agree to its terms.

10. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure, or that appointment availability shown will always be current. Information on the Site is general in nature and is not a substitute for a professional inspection of a specific property.

11. Limitation of Liability

To the fullest extent permitted by law, Midwest True Home Inspections, LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site itself is limited to $100. Liability relating to inspection services is governed exclusively by the Pre-Inspection Agreement. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend and hold harmless Midwest True Home Inspections, LLC and its owners, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law rules. Any dispute arising from your use of the Site will be brought exclusively in the state or federal courts located in Sedgwick County, Kansas, and you consent to their jurisdiction. Disputes about inspection services are governed by the Pre-Inspection Agreement.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and any signed Pre-Inspection Agreement, are the entire agreement between you and us about the Site.
